Probate administration, estate planning, wills, and trust management under Oregon law.
Overview
Our estate planning attorneys help you protect your assets and ensure your wishes are carried out under the Oregon probate code (ORS Chapters 111-118). We handle probate administration, will drafting and contests, revocable and irrevocable trusts, powers of attorney, advance directives, and guardianship and conservatorship matters. Erin Welden leads our Probate department, providing clear guidance through Oregon's probate process and helping Portland families plan for the future with confidence.
Our Services
A well-crafted will or trust is the foundation of any estate plan. Under ORS Chapters 111-118, Oregon has specific requirements for valid wills, trusts, and estate administration. We draft documents that comply with Oregon law while clearly expressing your wishes.
Revocable living trusts allow you to maintain control of your assets during your lifetime while ensuring a seamless transfer to your beneficiaries — without the delays and costs of probate. Irrevocable trusts offer stronger asset protection and potential tax benefits.
We help Oregon residents create comprehensive estate plans tailored to their family circumstances and financial goals.

When a loved one passes, our attorneys guide personal representatives through Oregon's probate process, including filing with the appropriate county court, notifying creditors, managing estate assets, and distributing property to beneficiaries.
Oregon probate can be complex, particularly when estates involve assets in multiple states, disputes among beneficiaries, or tax obligations. We handle all legal aspects of estate administration efficiently and cost-effectively.
We also assist with small estate affidavits for qualifying estates, which can bypass formal probate entirely under Oregon law.
Oregon law provides for durable powers of attorney (financial) and advance directives (healthcare) that ensure trusted individuals can manage your affairs if you become unable to do so.
A durable financial power of attorney allows your designated agent to handle financial matters on your behalf. Without this document, your family may need a court-appointed conservatorship — a costly and time-consuming process.
Oregon's Advance Directive form combines healthcare power of attorney with living will provisions, allowing you to specify treatment preferences and designate a healthcare representative in a single document.
Oregon imposes a state estate tax with an exemption of only $1 million — one of the lowest thresholds in the nation. Oregon does not have an inheritance tax. Oregon is NOT a community property state — it follows equitable distribution. Small estates under $75,000 in personal property and $200,000 in real property may use a simplified affidavit process (ORS 114.515). Oregon recognizes Transfer on Death Deeds for real property. Oregon's probate process typically takes 4-12 months.
